This Privacy Policy (this “Policy”) is effective as of January 1, 2023 (the “Effective Date”) and pertains to GradePro, Inc. (collectively, “GradePro”, “we”, and “us”).
This Policy describes GradePro’s practices with respect to information we collect and receive from users of our GradePro mobile application (the “App”) and through email, social media, and messaging applications in connection with the App (together with the App, the “Services”), including the categories of information collected, how that information is used, and with whom that information is shared.
By accessing, using, and requesting the Services, you agree and consent to the collection, maintenance, use, and disclosure of your personal information by GradePro. If you do not agree to the terms of this Policy or do not consent to the collection, maintenance, use, and disclosure of your personal information by GradePro as described within this Policy, you should leave the App and stop using and/or requesting our Services immediately.
We collect personal information through the App and when we deliver user support, and use it for typical business management, operational, and commercial purposes (including to maintain or service accounts, provide user support, perform analytics, store data, advertise and market, internal research, to verify and maintain the quality or safety of the Services, audit the use of the Services, defend and protect us and others from harm or legal claims, and as required by applicable law) and as described more specifically below:
We collect personal information from you if you use our App, connect the App with a school’s gradebook system, post to our social media pages or accounts, or otherwise voluntarily provide such information to us (e.g., in connection with ratings, reviews, requests for advice, suggestions).
Submitted through the App. We do not receive the personal information you submit through the App, except through the “Help & support” feature. The App receives the personal identifiers (such as your school’s gradebook system username and password) and education information (such as your school district name) you submit and uses them to connect with your school’s gradebook system to retrieve and display information from your school’s gradebook system through the App, but that information is not transmitted to us. We receive the personal information you voluntarily submit to us through the “Help & support” feature.
Collected through Social Media, Email, Messaging Applications, and App Stores. When you voluntarily submit them to us, we receive personal identifiers, such as your school gradebook system username and password, email address or social media username, and any other personal information you submit, when you communicate with us through email, social media, messaging applications, or app stores. For example, we may receive any ratings and reviews you post in app stores along with personal identifiers connected with your ratings and reviews. We may also ask that you voluntarily share your school’s gradebook system credentials in order to help our engineering team resolve bugs or support new school district gradebook systems. Your school gradebook system username and password may be considered sensitive personal information, and we do not generate inferences from the information.
From Third Parties. We may receive personal identifiers and educational gradebook system data from third parties. When you use the App, the App will receive personal identifiers and educational data from a school district’s gradebook system when you connect the App to your gradebook system account. The educational data will include, for example, names and student identifiers of students associated with that gradebook system account, class names, assignments, grades, averages, scores, attendance records, final exam scores, and final exam averages. That data remains on your device within the App, and we do not receive this data except in the following limited situations: you voluntarily share the data with us (for instance, while requesting user support), we view or receive the data during the course of improving the App at your request (e.g., resolving bugs or supporting new school gradebook systems), or the data is contained in App crash data (described below).
Automatic Collection of Device and App Usage Information. We and our service providers and third party partners, such as advertising networks and analytics providers and software error monitoring providers, automatically collect personal information using cookies and similar technology when you use the App and receive our communications. We use this information to provide and improve the App, for anti-fraud purposes, to tailor your experience on the App and our marketing efforts, and to create aggregate internal reports on App usage and activity. Please visit Your Privacy Choices in the App to personalize how we and our service providers and third party partners use automatically-collected personal information for targeted advertising purposes related to the App.
Sensitive personal information. Other than as stated above, we generally do not collect or process sensitive personal information (e.g., racial or ethnic origin, religious beliefs, mental or physical health data, sex life or orientation, citizenship status, biometric data for the purpose of uniquely identifying an individual, personal information from a known child, account credentials, or information that allows access to financial accounts) about users through the Services. If we collect and process sensitive personal information, we will provide a separate notice explaining our collection and processing of that information and collect and process it in accordance with applicable law.
De-identified or Aggregated Information. We de-identify and/or aggregate data we receive and may use and disclose it for any business or commercial purpose. Once de-identified, we will maintain the data in de-identified form and not attempt to re-identify it.
Retention of personal information. As a general matter, we keep information only for as long as necessary to fulfill the purposes for which it was collected, provide you with our products and services, resolve disputes and enforce agreements, and as stated in our retention policies or as permitted or required by law, such as to comply with recordkeeping and other legal obligations. There may also be residual information that will remain within our backup files, databases, and other records, which will not be removed or changed, except in accordance with retention policies.
Selling and Third Party Targeted Advertising. As stated more fully below, GradePro “sells” or “shares” personal information for third party targeted advertising as those terms are defined by applicable law. The personal information includes personal identifiers, personal characteristics, App usage activity, and inferences generated about you based on your App usage activity. You may opt out of the “sale” of personal information and the “sharing” of personal information for third party targeted advertising by visiting Your Privacy Choices.
We share the categories of personal information we receive (listed above) for our business and commercial purposes (including to maintain or service accounts, provide user support, perform analytics, store data, advertise and market, internal research, to verify and maintain the quality or safety of the Services, audit the use of the Services, defend and protect us and others from harm or legal claims, and as required by applicable law) and as more specifically described below.
Service providers. We share any of your personal information with service providers that provide services to us, including to help us maintain our App, administer emails, analytics, error monitoring and tracking, administer user support communications, and perform marketing and advertising.
Marketing companies. GradePro may permit third party partners and advertisers to track users of the App and the activities of those users and recipients over time, and they may track those visitors and recipients across other websites and online services over time, including for targeted advertising and joint marketing purposes. This may constitute the “sale” or “sharing” of your personal information for third party targeted advertising as defined by applicable state law. The personal information used and shared for these purposes includes personal identifiers, personal characteristics, mobile application usage activity, and inferences generated about you based on your mobile application usage activity. Public. If you choose to participate in a survey, product review or rating, or rate a review as helpful or not helpful, you may be providing information to a third party that we use to process product ratings and reviews. Product ratings and reviews may be published on the App, in app stores, in emails, on television, and on social media platforms. Published ratings and reviews may identify the author’s review nickname and locale. In these situations, you are using and directing us to intentionally disclose personal information (including personal identifiers) so your product ratings and reviews can be available to the public.
Government agencies, legal, and similar disclosures. We may disclose personal information about you with law enforcement, the courts, our advisors, attorneys, and others who participate in the legal process, if necessary to do so by law or based on our good faith belief that it is necessary to enforce or apply our App Terms of Use, conform or comply with the law or is necessary to protect us, the users of the App, or others.
Merger, sale, or other asset transfers. In the event of a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another business unit (whether by private sale, through operation of law, as part of a divestiture plan, or otherwise), we will provide any personal information (including commercial transaction information) associated with each such business unit to the persons and/or entities assuming control of such business unit and our advisors or as otherwise necessary to complete the transaction as permitted by law or contract.
Information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant, or guarantee the security or integrity of such information. We take steps in an effort to treat your information securely and in accordance with this Privacy Policy. However, we will not be responsible for disclosure of any information due to errors in transmission or the unauthorized acts of third parties.
The App is not intended for use by individuals under the age of thirteen (13). We do not intentionally collect personal information from users of the App who are under the age of thirteen (13).
Certain jurisdictions impose specific legal requirements and grant data subject rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. For example, you may have the right to know about our practices with respect to your personal information and to review, correct, receive, receive in a portable manner, and delete personal information we have about you, or to consent or withdraw consent to certain uses or sharing of personal information (e.g., a right to opt-out of the “sale” of personal information or “sharing” of personal information for targeted advertising, as described above). You may also have the right to not be discriminated against for exercising your privacy rights.
Making Requests. When you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your request and your location. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us do so.
You may have the right to use an authorized agent to make privacy rights requests. We may require the authorized agent to provide us with proof of your written permission (for example, an executed written consent form) that demonstrates authorization to submit a request for you. An authorized agent must follow the process described below to make a request, and we will also (a) require the authorized agent to verify the agent’s own identity and (b) confirm the agent’s authority with the individual about whom the request was made. Note that an authorized agent may not be able to fully complete certain opt-out requests on your behalf, because they impact your browser, mobile application, or device.
To make a request, you may email us at [email protected] or contact us using our user support system available in the App by tapping “Help & support.” In most cases, you will be required to provide your email address, school district name, and your username for your school’s gradebook system so that we can verify your request. In some cases, you may need to make a request through the “Help & support” feature so we can receive your device ID to identify your other user support requests, and in other cases additional information may be required.
Responding to Requests. We will respond to your request within the time period required by applicable law. However, we may not always be able to fully comply with your request, and we will notify you in that event. As permitted by applicable law, we may charge a reasonable fee to help cover the cost of responding to your request, and we will inform you of the fee before completing your request. Specific provisions for some jurisdictions are set forth below.
Appeals Process. Contact us at [email protected] to appeal our decision to deny your request. Please include in your appeal request all information about your original request and our denial response to you. We will review and respond to your appeal as required by applicable law.
Do Not Sell and Opting Out of Targeted Advertising. As stated above, GradePro “sells” personal information or “shares” personal information for third party targeted advertising as defined by applicable state law. Please visit Your Privacy Choices to request that we limit this selling or sharing for targeted advertising.
We have disclosed in the last 12 months the categories of personal information listed above in this Policy for our business and commercial purposes (including to maintain the App, provide user support, perform analytics, store data, advertising and marketing, internal research, to verify and maintain the quality or safety of products and services, auditing the use of the Services or other products or services, defend and protect us and others from harm or legal claims, and as required by applicable law). We do not use or disclose sensitive personal information for purposes other than those specified in section 7027, subsection (m).
California residents have the privacy rights listed above in this Policy. In addition to the privacy rights listed above, California residents have a right to know the categories of personal information collected, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom the business discloses personal information, and the specific pieces of personal information the business has collected about them.
California residents may make a privacy request by emailing us at [email protected] or contacting us using our user support system available in the App by tapping “Help & support.”
As stated above, GradePro “sells” or “shares” personal information for targeted advertising in the App (as those terms are defined by California law). We will not knowingly sell the personal information of individuals we know are under 16 years old without prior consent. California residents may opt out of the “sale” or “sharing” of personal information for third party targeted advertising by visiting Your Privacy Choices. We do not rent, sell, or share personal information (as defined by California Civil Code §1798.83) about you that we collect on the App with other people or unaffiliated companies for their direct marketing purposes, unless we have your permission.
If you are using the Services, you agree to the transfer of your information to the United States and processing globally. By providing your information you consent to any transfer and processing in accordance with this Privacy Policy.
We reserve the right to revise this Policy at any time. When we do, we will give you notice of the revised Policy by posting it on the App and by updating the Effective Date at the top of the Policy. If we make any material changes, we will let you know through the App, by email, or other communication. You are responsible for regularly reviewing the current Policy. The most current version of the Policy may be reviewed by clicking on the “Privacy” or “Privacy Policy” hypertext located at the bottom of the App. Your continued use of the App after we post any revisions constitutes your agreement to any such revisions. If any such revisions are unacceptable to you, do not access the App and do not submit any information to us.
While you are using the App, you may be linked or directed to other third party sites outside of our App that are beyond our control or may see data retrieved from school gradebook systems. Each of these third party sites and systems may have a privacy policy that differs from ours. For example, you might click on a link or banner advertisement that takes you off of our App. These links and banners may take you to the sites of advertisers, sponsors, and co-branding partners. It is your responsibility to review the privacy policies of those sites. We are not responsible for any actions or policies of such third parties.
